Terms of Service

Welcome to Neshama (the "App"). These terms form a binding legal agreement between you and us. Use of the App constitutes full agreement to these Terms. If you do not agree, please do not use the App.

1. Eligibility

Use of the App is permitted from age 16 and older. For users under 18, use is conditioned on consent from a parent or guardian.

2. License

We grant you a personal, limited, non-exclusive, non-transferable license to use the App on an iOS device that you own, subject to these Terms and to Apple's Standard End User License Agreement. You may not copy, modify, reverse engineer, or distribute the App. We may modify, add, or remove features from time to time.

3. Subscriptions

The App offers a paid subscription ("Premium") that unlocks advanced features (such as the AI learning companion, widgets, the extended highlight palette, and Streak Revive). Pricing and any free trial are displayed in the App at the App Store at the time of purchase. The subscription renews automatically at the end of each period unless canceled at least 24 hours before the end of the period. You may cancel at any time through your Apple ID settings. Billing and refunds are handled by Apple. Refund requests should be directed to reportaproblem.apple.com.

4. AI feature disclaimer

The AI learning companion is an educational tool intended to support Jewish text study and the prayer experience. The learning companion is not a rabbi (poseik) and does not issue halachic rulings.It must not be treated as a substitute for rabbinic decision-making, personal guidance from a qualified rabbi, or professional advice in any domain. The companion's answers are generated by a third-party AI model and may contain inaccuracies. Do not rely on it for decisions related to halacha, medicine, law, psychology, or finance. For practical halachic questions, consult a qualified rabbi whom you trust.

5. Acceptable use

When using the App, you agree not to transmit unlawful or harmful content, attempt to bypass content restrictions or inject malicious instructions, or use the App to develop a competing model or extract data. Violation may result in termination of your use.

6. Disclaimer ("as is")

The App is provided to you "AS IS" and "AS AVAILABLE", without any representation or warranty, express or implied. We do not warrant that the App will operate uninterrupted or that the AI feature will produce accurate answers.

7. Limitation of liability

To the maximum extent permitted by law, our total liability to you in connection with the App shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event, or (b) ILS 100. This section does not apply to liability that cannot be limited under law, including in cases of gross negligence or willful misconduct.

8. Apple-specific clauses

These Terms are entered into between you and us only. Apple is not responsible for the App or its content and is not a party to this agreement, but Apple and its subsidiaries are third-party beneficiaries entitled to enforce these Terms against you. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any).

9. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel. The courts of competent jurisdiction in the Tel Aviv District, Israel, shall have exclusive jurisdiction over any dispute. This does not affect any mandatory consumer rights granted to you under the law of your place of residence.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be presented inside the App. If any provision herein is held invalid, the remaining provisions shall remain in force.
